SHIPPING POLICY

La Chancla Wine is a registered trade name (DBA) of Texas Red Wines LLC

Effective Date: 04/13/2026 Subject to Texas Alcoholic Beverage Code & Federal Law

SECTION 1 — OVERVIEW

La Chancla Wine (Texas Red Wines LLC) ships wine and merchandise directly to consumers (DTC) across the United States where permitted by law. Because wine is an age-restricted alcoholic beverage regulated by the Texas Alcoholic Beverage Commission (TABC), the U.S. Alcohol and Tobacco Tax and Trade Bureau (TTB), and the laws of each destination state, our shipping practices are subject to legal requirements that differ meaningfully from those of a standard e-commerce retailer. For shipments within Texas and Florida, La Chancla Wine fulfills orders directly. For all other states, wine orders are fulfilled through VinoShipper, a licensed third-party DTC wine compliance and shipping platform. Orders shipped outside of Texas and Florida are subject to VinoShipper’s terms, conditions, and legal authorizations, and availability is limited to the states VinoShipper is currently licensed and authorized to service. We do not ship to all states.

Please read this Shipping Policy carefully before placing an order. By completing a purchase, you acknowledge and agree to all terms described herein, including the adult signature requirement, geographic restrictions, and failed-delivery procedures. This policy should be read alongside our Terms of Service and Return & Refund Policy.

 

SECTION 2 — AGE VERIFICATION & ADULT SIGNATURE REQUIRED

FEDERAL & STATE LAW REQUIREMENT — NO EXCEPTIONS
All wine shipments from La Chancla Wine require an adult signature (21+) with a valid government-issued photo ID at the time of delivery. This is a requirement of the Texas Alcoholic Beverage Code § 16.09(d) and the regulations of all 48 states and DC where DTC wine shipping is permitted. Our carriers are legally required to enforce this — there are NO exceptions, including for gifts, unattended porches, or leasing office drop-offs.

 

At the time of delivery, the recipient must:

     Be physically present at the delivery address;

     Be 21 years of age or older;

     Present a valid, unexpired government-issued photo ID (driver’s license, state ID, passport, or military ID);

     Provide a signature on the carrier’s device or paper manifest confirming receipt.

 

The carrier’s delivery driver is authorized and required to refuse delivery if the recipient:

     Is not present or no eligible adult (21+) is available;

     Cannot produce a valid, unexpired government-issued photo ID;

     Appears to be under 21 after ID inspection;

     Appears to be intoxicated at the time of delivery.

 

Wine shipments cannot be left at a door, with a neighbor, at a leasing office, or in any unattended location. Carriers are prohibited by law from doing so. If no eligible adult is available to accept the delivery after required delivery attempts, the shipment will be returned to La Chancla Wine. See Section 9 (Failed & Returned Deliveries) for details.

 

SECTION 3 — WHERE WE SHIP: GEOGRAPHIC AVAILABILITY & RESTRICTIONS

3.1 — U.S. DTC Wine Shipping — 2026 Status

As of 2026, La Chancla Wine ships to most states in the contiguous United States where direct-to-consumer winery wine shipping is legally permitted and where we hold the required state license or permit. DTC wine shipping laws vary significantly by state, and we are obligated to comply with each destination state’s rules including volume limits, permit requirements, labeling, and tax collection.

EFFECTIVELY UNAVAILABLE

Delaware — a DTC law was enacted in 2025 but contains provisions (high licensing cost, extremely low volume limits, wholesale/DTC exclusivity) that make lawful shipping impractical. We do not currently ship to Delaware.

REMOTE/ONLINE ORDERS BLOCKED

Rhode Island — on-site purchase requirement remains in effect; remote and online wine orders cannot be shipped to RI consumers.

 

State DTC wine shipping laws are subject to change. We update our shipping availability continuously to reflect new legislation, permit approvals, and regulatory guidance. If your state does not appear in our checkout as a valid shipping destination, we are not currently permitted to ship there. We will not accept or fulfill orders to restricted or prohibited states. If a prohibited destination is entered, the order will be cancelled and a full refund issued. Please note that orders to states other than Texas and Florida are fulfilled through VinoShipper and are subject to the states VinoShipper is authorized to service at the time of your order — this list may differ from the general DTC availability table above. We do not ship to all states.

 

3.2 — Dry Counties, Cities & Local Restrictions

Within states where DTC wine shipping is generally permitted, individual counties, cities, or municipalities may be classified as “dry” or “damp,” prohibiting or restricting the delivery of alcoholic beverages. You are responsible for knowing whether wine delivery is lawful at your specific delivery address. We verify addresses against known dry/restricted areas at checkout and reserve the right to cancel orders destined for prohibited localities. A full refund will be issued for any order cancelled for this reason.

 

3.3 — Texas Shipment Volume Limits

For shipments within Texas, direct-to-consumer wine shipments are subject to the volume limits established by Texas Alcoholic Beverage Code § 16.09:

     Maximum of 9 gallons (approximately 3.75 standard cases of 750 ml bottles) per calendar month per consumer;

     Maximum of 36 gallons (approximately 15 standard cases) per 12-month period per consumer.

Orders that would cause these limits to be exceeded will be declined or adjusted at checkout. These limits apply in aggregate across all orders placed to the same delivery address within the applicable period.

 

3.4 — No International Shipping

We do not currently ship wine or merchandise outside of the United States. All orders must have a valid U.S. delivery address. We do not ship to U.S. territories, APO/FPO/DPO military addresses, or P.O. Boxes for wine orders (see Section 10).

 

SECTION 4 — CARRIERS & TABC COMPLIANCE

All wine shipments from La Chancla Wine are shipped exclusively through carriers that hold a valid TABC Carrier’s Permit as required by Texas Alcoholic Beverage Code § 16.09 and that are licensed or authorized to transport alcoholic beverages in the destination state. We currently ship via:

     FedEx (primary carrier) — via FedEx Wine Shipping Program, with adult signature required at delivery;

     UPS (secondary carrier) — via UPS Wine Shipping Program, with adult signature required at delivery;

     [INSERT ADDITIONAL CARRIER IF APPLICABLE] — TABC Carrier’s Permit No. [INSERT].

 

All wine packages are labeled in accordance with Texas Alcoholic Beverage Code § 16.09(b), which requires packages to bear a conspicuous label stating: “Contains Alcohol: Signature of person 21 years or older required for delivery.” This label appears on every shipment we send.

We do not use carriers that do not hold the required federal and state permits to transport alcoholic beverages. We will not fulfill wine orders using personal vehicles, unlicensed couriers, rideshare platforms, or any carrier not authorized under applicable law.

 

SECTION 4A — VINOSHIPPER: OUT-OF-STATE FULFILLMENT PLATFORM

IMPORTANT — HOW WE SHIP OUTSIDE TEXAS & FLORIDA
For shipments within Texas and Florida, La Chancla Wine (Texas Red Wines LLC) fulfills orders directly under its own TABC permit and applicable state authorizations. For all other U.S. states, wine orders are fulfilled through VinoShipper (vinoshipper.com), a licensed third-party direct-to-consumer wine compliance and fulfillment platform. By placing an order for delivery to any state other than Texas or Florida, you acknowledge and agree that your order is subject to VinoShipper’s Terms of Service, legal authorizations, and state-by-state shipping permissions. We do not ship to all states. Availability is governed by VinoShipper’s current licensing footprint, which may be more limited than the general DTC map shown in Section 3.

 

VinoShipper is a DTC wine compliance platform that holds state-specific winery licenses and direct shipper permits across multiple U.S. states, enabling wineries and wine brands to lawfully fulfill consumer orders in states where they do not independently hold a permit. When your order is routed through VinoShipper, the legal transaction for compliance purposes occurs through VinoShipper’s licensed entity in accordance with that state’s alcohol beverage laws. VinoShipper handles state excise tax collection and remittance, compliance reporting to applicable state alcohol beverage control agencies, and carrier coordination for all out-of-state orders it fulfills on our behalf.

What this means for you as a customer:

      State availability: We do not ship to all states. Shipping availability for out-of-state orders is determined by the states in which VinoShipper holds active licenses and permits at the time of your order. VinoShipper’s authorized state list may differ from the general DTC availability table in Section 3 and is subject to change without notice. The checkout process will reflect only currently available destinations.

      Third-party terms apply: Your out-of-state wine order is subject to VinoShipper’s Terms of Service and Policies in addition to this Shipping Policy and La Chancla Wine’s Terms of Service. In the event of a conflict between VinoShipper’s terms and ours with respect to out-of-state fulfillment, VinoShipper’s terms govern for matters within their operational and legal purview (e.g., state compliance, licensing, carrier selection, and tax remittance). VinoShipper’s current Terms of Service are available at vinoshipper.com.

      Compliance and taxes: For out-of-state orders, VinoShipper is responsible for calculating, collecting, and remitting applicable state wine excise taxes and sales taxes in accordance with each destination state’s requirements. Tax amounts will be displayed at checkout.

      Adult signature: The same adult signature (21+) and government-issued photo ID requirements described in Section 2 apply to all VinoShipper-fulfilled orders without exception.

      Volume limits: State-specific volume and frequency limits for DTC wine shipments (e.g., cases per month or year) are enforced by VinoShipper’s platform at the time of order. Orders that exceed applicable limits for your state will be declined or adjusted at checkout.

      Limitation of liability: La Chancla Wine’s liability for out-of-state orders fulfilled through VinoShipper is limited to matters within our direct operational control. We are not responsible for delays, compliance decisions, carrier actions, or order denials resulting from VinoShipper’s platform, licensing status, or third-party carrier performance. For issues specific to VinoShipper’s platform or a state compliance decision made by VinoShipper, we will direct you to VinoShipper’s customer support. SECTION 5 — ORDER PROCESSING TIMES

Orders are processed Monday through Friday, excluding federal holidays and the following Texas state holidays: [INSERT HOLIDAYS]. Processing time is separate from shipping transit time.

Orders placed after 12:00 PM Central Time (CT) on a business day will begin processing the following business day. Orders placed on weekends or holidays will begin processing the next business day. During peak periods (holiday season, new release weeks, harvest season), processing times may be extended. We will communicate delays by email.

 

SECTION 6 — SHIPPING METHODS & RATES

Shipping rates are calculated at checkout based on your delivery address, the weight and dimensions of your order, and the applicable carrier rate for your destination state. All rates displayed at checkout include the carrier’s adult-signature-required service fee, which is mandatory for wine shipments. Rates are subject to carrier fuel surcharges and are updated periodically.

6.2 — Shipping Service Options

6.3 — Free Shipping Offers

From time to time, La Chancla Wine may offer free or discounted shipping promotions. Free shipping offers apply to ground service only, to eligible destinations, and are subject to minimum order requirements stated in the promotion. Free shipping is not available on orders to states where ground service is not authorized for wine, or during weather holds. Promotion terms govern over this policy where there is a conflict.

 

6.4 — Sales Tax & Excise Tax

Texas state and local sales tax is collected on all orders delivered to a Texas address in accordance with Texas Tax Code Chapter 151. For orders shipped to other states, we collect and remit sales tax and state wine excise tax as required by the destination state’s laws and our DTC permit obligations in that state. Applicable taxes are calculated and displayed at checkout before you confirm your order.

 

SECTION 7 — WINE PACKAGING & LABELING

Wine is fragile, perishable, and subject to federal and state packaging requirements. All wine shipped by La Chancla Wine is packaged as follows:

     Bottles are packed in purpose-built wine shipper cartons (corrugated fiberboard) with individual styrofoam or molded pulp bottle dividers to prevent breakage;

     Each outer carton is labeled in compliance with Texas Alcoholic Beverage Code § 16.09(b): “Contains Alcohol: Signature of person 21 years or older required for delivery;”

     Packages are sealed with tamper-evident tape and may bear additional carrier-required alcohol shipping labels;

     Packing slips inside the box list the contents and confirm the order.

 

We do not use plain brown boxes or generic packaging for wine shipments, as carrier wine shipping programs require the use of approved wine shipper packaging. If you have specific packaging requests (e.g., gift wrapping, blind shipment with no La Chancla branding), please contact us at info@lachanclawine.com before placing your order.

 

SECTION 8 — WEATHER & TEMPERATURE HOLDS

Wine is a perishable product that can be permanently damaged by extreme heat or cold during transit. We monitor weather conditions and carrier temperature advisories continuously and reserve the right to place a weather hold on any shipment where we believe transit conditions present an unacceptable risk of heat or freeze damage.

 

8.1 — Heat Holds

During periods of high ambient temperature — generally when forecast temperatures along the shipping route or at the destination exceed 85°F (29°C) for extended periods — we may:

     Hold your order until temperatures are suitable for ground shipping;

     Recommend or automatically upgrade your shipment to 2-Day Air or Overnight Air at an additional charge (we will notify you before billing);

     Contact you to discuss options if a hold is expected to last more than 5 business days.

 

8.2 — Freeze Holds

During winter months, particularly for orders shipping to northern states, we may delay shipments when forecast temperatures along the route drop below 28°F (-2°C) for extended periods to prevent freeze damage.

 

8.3 — Customer Responsibility for Weather Damage

Once a shipment is released by us and accepted by the carrier in appropriate conditions, and any weather damage that occurs during transit results from unforeseen temperature changes, carrier delays, or storage conditions outside our control, La Chancla Wine is not liable for temperature-related wine damage. Title and risk of loss pass to the buyer upon carrier acceptance (see Terms of Service, Section 7). We strongly recommend 2-Day Air or Overnight Air shipping for orders placed between May and September, and for all shipments to southern, desert, and Gulf Coast states.

 

WARM-WEATHER SHIPPING RECOMMENDATION
May through September, and year-round for Texas, Arizona, New Mexico, Nevada, Florida, Louisiana, and other warm-climate states: We strongly recommend selecting 2-Day Air or Overnight Air at checkout to protect your wine from heat damage. Ground transit to southern destinations can take 5–7 days, during which temperatures inside a delivery truck can exceed 130°F (54°C). La Chancla Wine is not responsible for heat damage to wine shipped via ground at the customer’s selection during high-risk periods.

 

SECTION 9 — FAILED DELIVERIES & RETURNED SHIPMENTS

9.1 — Delivery Attempts

If no eligible adult (21+) is available to sign for the shipment, the carrier will leave a delivery attempt notice and make additional attempts as follows:

     FedEx: Up to 3 delivery attempts on separate business days before the package is returned to sender.

     UPS: Up to 3 delivery attempts on separate business days before the package is returned to sender.

After failed delivery attempts, the carrier may hold the package at a local facility for a limited period (typically 5–7 business days) before returning it to us. You may be able to redirect the shipment or schedule a specific delivery time through the carrier’s app or website using your tracking number.

 

9.2 — Returned Shipments — Fees & Process

If a wine shipment is returned to La Chancla Wine due to a failed delivery (no adult present, address error, or refused delivery), the following charges apply:

If a returned shipment arrives back to us damaged, temperature-compromised, or otherwise not in resalable condition due to transit conditions during the return leg, we reserve the right to deny a product refund. We will notify you of the condition of the return within 3 business days of receipt.

To avoid return fees, please ensure that a responsible adult (21+) will be available to accept the shipment at the delivery address. Consider scheduling the delivery for a day when someone will be home, or using a workplace or other address where an adult is available during carrier delivery hours.

 

9.3 — Refused Deliveries

If you choose to refuse a wine delivery, the shipment will be returned to us and the return fees described in Section 9.2 will apply. If you wish to cancel an order before it ships, contact us immediately at info@lachanclawine.com. Once a shipment has been picked up by the carrier, we cannot cancel the order and a refused-delivery return fee will apply.

 

SECTION 10 — P.O. BOXES, MILITARY & U.S. TERRITORY ADDRESSES

Wine shipments cannot be delivered to P.O. Boxes, UPS Store mailboxes, or similar non-residential mailing addresses. Adult signature and ID verification at delivery cannot be completed at an unmanned mailbox, and carrier wine shipping programs do not permit delivery to P.O. Boxes. Please provide a valid residential or commercial street address at checkout.

We do not currently ship to APO, FPO, or DPO military addresses, or to U.S. territories including Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, and the Northern Mariana Islands. Wine shipments to these locations are not authorized under the applicable carrier programs and may not comply with local alcohol regulations.

Non-wine merchandise may be shipped to P.O. Boxes and most U.S. territories where standard carrier service is available. Separate shipping rates apply.

 

SECTION 11 — ORDER TRACKING

Once your order is processed and picked up by the carrier, you will receive an automated shipping confirmation email containing:

     Your carrier tracking number with a direct link to the carrier tracking page;

     The estimated delivery date based on carrier transit time;

     A reminder of the adult signature requirement and what to expect at delivery.

Estimated delivery dates provided by carriers are not guaranteed. La Chancla Wine is not liable for delays caused by carrier operational issues, weather, natural disasters, labor actions, regulatory inspections, or other events outside our control.

 

SECTION 12 — DAMAGED, DEFECTIVE & LOST SHIPMENTS

12.1 — Inspecting Your Delivery

Please inspect the outer packaging before accepting and signing for your wine delivery. If the box shows visible signs of damage — crushing, puncture, leakage, or severe mishandling — you may:

     Refuse the delivery: The carrier will mark it as refused and return it to us. Contact us at info@lachanclawine.com immediately so we can initiate a carrier claim and arrange a replacement or refund.

     Accept with notation: If you choose to accept a visibly damaged box, note “package damaged” on the carrier’s delivery device or slip before signing. Then contact us within 48 hours with photographs of the damage.

 

12.2 — Reporting Damage

If you discover damage, breakage, or defect after opening your delivery, contact us within 48 hours of delivery at info@lachanclawine.com with:

     Your order number;

     Clear photographs of the damaged item(s), the inner packing materials, and the outer box (including all six sides);

     A description of the damage or defect.

Failure to report within 48 hours may limit our ability to file a successful carrier insurance claim or TABC-required damage report, and may result in denial of the claim. Do not discard the packaging or bottles until your claim is fully resolved.

 

12.3 — Lost Shipments

A shipment is considered lost if the carrier’s tracking system shows no delivery scan within 3 business days after the estimated delivery date, or if delivery is confirmed by the carrier but you did not receive the package.

To report a lost shipment, contact us at info@lachanclawine.com with your order number and tracking number. We will open a trace or lost package claim with the carrier on your behalf. Carrier claims typically take 7–14 business days to resolve. Once the carrier confirms the package is lost, we will ship a replacement or issue a full refund at your preference.

Note: If the carrier’s tracking confirms delivery was completed (adult signature obtained), we cannot treat the shipment as lost and a carrier claim will be required. We will assist you in that process.

 

12.4 — Shipping Insurance

All shipments include carrier baseline insurance for the declared value of the shipment. For orders above the carrier’s baseline coverage threshold, we may purchase additional declared value coverage. Details of coverage for your specific order are available upon request. You may request additional insurance coverage at checkout or by contacting us before your order ships.

 

SECTION 13 — GIFT SHIPMENTS

Wine makes a wonderful gift — with a few important considerations unique to alcohol shipping:

     The recipient must be 21 years of age or older and must be present to sign for the delivery with valid government-issued photo ID. If the recipient is unavailable, the package cannot be left and will follow the failed-delivery process described in Section 9.

     We recommend notifying the recipient in advance that a wine shipment is coming and that their signature and ID will be required.

     We offer gift messaging at checkout. Gift messages are printed on a card included in the shipment.

     For gifts, we can omit the packing slip (price information) upon request — select “Blind Ship / Gift” at checkout or note it in your order comments. La Chancla Wine branding will still appear on the outer packaging as required by carrier wine shipping programs.

     Gift wine shipments are subject to all the same age verification, signature, geographic, and volume-limit requirements as any other order.

 

SECTION 14 — WINE CLUB SHIPMENTS

La Chancla Wine club members receive scheduled wine shipments as part of their membership. The following shipping terms apply to club shipments:

     Club shipments are processed and shipped on the club’s scheduled ship dates. Members will receive an email notification at least 7 days before their shipment is processed, allowing time to update delivery addresses, hold shipments, or make changes.

     All club wine shipments are subject to the same adult signature, geographic restriction, weather hold, and failed-delivery policies described in this Shipping Policy.

     Club members are responsible for ensuring their delivery address is valid, accessible to carriers, and that a 21+ adult will be available on or around the expected delivery date.

     Shipping rates for club shipments are stated in your club membership agreement and may differ from standard checkout rates.

     If a club shipment is returned due to a failed delivery, the return fees in Section 9.2 apply.

 

SECTION 15 — HOLIDAY SHIPPING NOTICE

During peak holiday periods (Thanksgiving week, December 1–24, Valentine’s Day, Mother’s Day, Father’s Day, and New Year’s), carrier volumes increase significantly and transit times may be extended beyond normal estimates. To ensure timely delivery of holiday gifts:

     Order early — we recommend placing holiday orders at least 7–10 business days before the desired delivery date;

     Consider 2-Day Air or Overnight Air for time-sensitive deliveries;

     Monitor your tracking number — carrier delays during peak periods are outside our control;

     Remember that carriers do not deliver wine on Sundays, federal holidays, or certain state holidays.

 

La Chancla Wine is not responsible for carrier delays during peak periods. Estimated delivery dates displayed at checkout during holiday periods are carrier estimates, not guarantees. We will communicate expected delays on our website and by email.

 

SECTION 16 — ORDER CHANGES & CANCELLATIONS AFTER SHIPPING

Once your order has been accepted by the carrier and is in transit:

     We cannot cancel the order or intercept the shipment without carrier assistance, which is not guaranteed and may incur a fee.

     Address corrections after carrier pickup may be possible through the carrier’s redirect service but are subject to availability and an additional fee charged by the carrier. Contact us immediately at info@lachanclawine.com if you need to update a delivery address after your shipment has been picked up.

     If you need to refuse the delivery, follow the instructions in Section 9.3. Return fees will apply.

 

SECTION 17 — NON-WINE MERCHANDISE SHIPPING

Non-alcoholic merchandise (branded accessories, glassware, apparel, and gift items) is shipped via standard carrier service and is not subject to the adult signature, age verification, or geographic restrictions that apply to wine.

     Merchandise ships to all 50 U.S. states, Washington D.C., and most U.S. territories.

     Standard shipping rates apply and are calculated at checkout.

     P.O. Box delivery is available for merchandise.

     Processing time is 1–2 business days; transit time is 3–7 business days for standard ground service.

Mixed orders containing both wine and non-alcoholic merchandise will ship together as a single package and are subject to the wine shipping rules in this policy.

 

SECTION 18 — REGULATORY COMPLIANCE STATEMENT

La Chancla Wine / Texas Red Wines LLC operates all wine shipments in compliance with:

     Texas Alcoholic Beverage Code (TABC) §§ 16.09, 101.68, 102.07 — direct shipping, age verification, and carrier permit requirements;

     Applicable DTC winery permit or license requirements in each destination state where we ship;

     Federal Alcohol Administration Act (27 U.S.C. § 201 et seq.) — labeling and advertising requirements;

     U.S. Alcohol and Tobacco Tax and Trade Bureau (TTB) regulations — product registration and tax reporting;

     21st Amendment Enforcement Act (27 U.S.C. § 122a) — state alcohol shipping authority;

     Applicable state excise tax and sales tax obligations in all destination states.
