RETURN & REFUND POLICY
La Chancla Wine is a registered trade name (DBA) of Texas Red Wines LLC

IMPORTANT LEGAL NOTICE — PLEASE READ
Under the Texas Alcoholic Beverage Code (§§ 101.68, 102.07, and 104.05) and official TABC guidance (Marketing Practices Bulletin MPB-027), the return or exchange of alcoholic beverages is strictly limited by Texas law. La Chancla Wine may not accept returns or issue refunds for alcoholic beverages based on personal preference, incorrect selection, change of mind, or over-purchase. Returns and refunds are available only in the specific circumstances described below. By placing an order, you acknowledge and agree to this policy.
SECTION 1 — WINE RETURNS: TEXAS LAW & ELIGIBILITY
Pursuant to Texas Alcoholic Beverage Code §§ 101.68, 102.07, and 104.05, and TABC Marketing Practices Bulletin MPB-027, alcoholic beverages sold by La Chancla Wine may only be returned, exchanged, or refunded under the following limited circumstances:
Eligible Return & Replacement Circumstances:
• The wine was damaged upon or prior to delivery (e.g., broken bottle, leaking cork, compromised seal).
• The wine was unfit for consumption upon delivery due to a manufacturing defect, such as confirmed cork taint (TCA), oxidation, or refermentation attributable to the producer.
• You received the wrong item — meaning the product delivered does not match your confirmed order.
• The product is subject to a manufacturer or producer safety recall or TABC-directed recall.
Non-Eligible Circumstances — Returns Will Not Be Accepted For:
• Personal preference, dislike of flavor, aroma, or style.
• Incorrect selection or over-purchase by the customer.
• Temperature or condition issues resulting from improper storage after delivery and acceptance.
• Opened bottles, unless the defect (e.g., cork taint) could not reasonably be identified without opening.
• Bottles purchased as final sale, at a discount, or as part of a clearance promotion.
• Gift card purchases.
These restrictions are not discretionary — they reflect the requirements of Texas law. La Chancla Wine has no legal authority to accept returns or issue refunds outside of these circumstances, and any attempt to process such a return would constitute a violation of the Texas Alcoholic Beverage Code.
SECTION 2 — REPORTING WINDOW FOR DAMAGED OR DEFECTIVE WINE
In alignment with TABC guidance requiring prompt reporting of product defects and delivery discrepancies, all claims for damaged, defective, or incorrect wine must be initiated within 48 hours of delivery acceptance. This window exists because wine condition can change after delivery due to storage conditions, making it difficult to verify the source of any defect beyond this period.
To initiate an eligible claim, contact us at info@lachanclawine.com within 48 hours of receiving your order. Your notification must include:
• Your full name and order number.
• A clear description of the defect, damage, or discrepancy.
• Photographs of the affected bottle(s), packaging, and shipping label.
• Whether the outer shipping carton showed signs of damage at time of delivery.
Failure to report within 48 hours may result in the claim being denied, as La Chancla Wine cannot verify whether damage or defects arose prior to or after delivery. Please do not discard any packaging, bottles, or materials until your claim is resolved.
SECTION 3 — NON-WINE MERCHANDISE (ACCESSORIES, APPAREL & GIFTS)
For non-alcoholic items sold through our store — including wine accessories, glassware, apparel, branded merchandise, and gift items — the following return conditions apply:
Eligibility Requirements:
• Item must be in the same condition as received — unused, unaltered, with all original tags attached.
• Item must be in its original, undamaged packaging.
• A receipt or valid proof of purchase is required.
• Request must be initiated within 30 days of the delivery date.
Non-Returnable Non-Wine Items:
• Custom, personalized, or special-order items.
• Perishable goods (food items, flowers, or plants).
• Personal care or hygiene products.
• Hazardous materials, flammable products, or compressed gases.
• Items marked as Final Sale or clearance at time of purchase.
• Gift cards.
SECTION 4 — HOW TO INITIATE A RETURN
To start a return for an eligible item, contact us first — do not ship anything back without prior authorization. Items sent back without a Return Merchandise Authorization (RMA) will not be accepted and may be abandoned.
Step 1: Email info@lachanclawine.com with your order number, item(s) to be returned, and reason for return. For wine claims, include photographs as described in Section 2.
Step 2: We will review your request and respond within 2–3 business days with a determination and, if approved, a Return Merchandise Authorization (RMA) number and instructions.
Step 3: For approved non-wine returns, we will provide a prepaid return shipping label. For approved wine claims involving damage or defect, we may arrange pickup or request additional documentation before issuing a replacement or credit.
Step 4: Upon receipt and inspection of returned merchandise, we will process your refund or replacement.

Returns accepted by appointment / authorization only. Unauthorized returns will not be accepted.
SECTION 5 — INSPECT YOUR ORDER UPON DELIVERY
Please inspect your order immediately upon receipt. Before signing for or accepting a wine delivery, check the outer packaging for visible signs of damage, crushing, or leakage. If the carrier has damaged the package in transit, you may refuse delivery and the package will be returned to us — please notify us immediately at info@lachanclawine.com if you refuse a shipment.
If you accept delivery and subsequently discover damage, defect, or an incorrect item, contact us within 48 hours per Section 2. Do not discard any packaging, bottles, or materials until your claim is fully resolved, as these may be needed for carrier insurance claims or TABC documentation.
SECTION 6 — EXCHANGES
Due to Texas Alcoholic Beverage Code restrictions, we cannot process like-for-like exchanges of wine except in cases involving a wrong item delivered or a TABC-authorized product replacement. For non-wine merchandise, the fastest way to get what you want is to initiate a return for the original item per Section 4, and once the return is accepted, place a new order for the desired item.
SECTION 7 — ORDER CANCELLATIONS
You may request a cancellation before your order has been processed for fulfillment or transferred to a carrier. To request a cancellation, contact us immediately at info@lachanclawine.com with your order number. We cannot guarantee cancellation for orders already in fulfillment or shipped.
If your order has already shipped and you wish to cancel, you must refuse delivery at the door (do not open or accept the package). Refused shipments will be returned to us and a refund will be issued for the product cost, minus any applicable return shipping and restocking fees, once the product is received and inspected.
SECTION 8 — REFUNDS
Once an approved return or claim is received and inspected, we will notify you by email of the refund determination. Approved refunds will be applied to your original payment method within 10 business days of approval. Please allow additional time for your bank or credit card company to process and post the credit.
Refunds for wine will be limited to the product price and applicable taxes. Original shipping charges are non-refundable unless the return is due to our error (wrong item shipped) or a verified carrier damage claim. Return shipping costs for non-wine items will be covered by La Chancla Wine for approved returns.
If more than 15 business days have passed since we approved your refund and you have not received the credit, please contact us at info@lachanclawine.com.
La Chancla Wine will not issue refunds for wine returns based on personal preference, taste, or incorrect customer selection. This is not a discretionary policy — it is a requirement of Texas law.
SECTION 9 — CARRIER DAMAGE & SHIPPING INSURANCE
Once wine is tendered to a TABC-permitted carrier, title and risk of loss passes to the buyer. If your shipment was damaged in transit, we will assist you in filing a claim with the carrier or our shipping insurer. Your cooperation — including retaining all packaging materials, providing photographs, and allowing inspection — is required to support a successful claim.
La Chancla Wine provides baseline shipping insurance up to the declared value of the shipment. We are not responsible for carrier delays, losses, or damages beyond our insurance coverage, but we will make reasonable efforts to assist you in recovering compensation through the carrier's claims process.
